OFFICIAL CONTEST RULES
ELIGIBILITY : To be eligible, you must be a legal resident of Canada. If you are under the age of 18, you must have permission from your parent or legal guardian to participate. Employees of Microsoft Canada Inc. (“Microsoft” or “Sponsor”) are eligible to participate. Microsoft is committed to complying with government gift and ethics rules and therefore government employees are not eligible to participate.
CONTEST PERIOD : The Contest will begin at 9:00am Eastern Time (“ET”) on August 20, 2018 and end at 11:59:59pm ET on September 20, 2018 (“Contest Period”).
HOW TO ENTER : No purchase necessary. To enter, visit https://microsoft.ca/teachers (“Contest Website”) and follow the instructions to enter. Entrants (the “Entrant”) will be required to create a video or written submission about a current primary or secondary school teacher (the “Teacher”) who has impacted and inspired a student’s life. All Teachers nominated must be a current primary or secondary school educator in Canada. “Primary School” means Kindergarten – Grade 8 inclusive. “Secondary School” means Grade 9 – Grade 12 inclusive to be eligible to be recognized. Entries should include as many of the following as possible:
- How the Teacher has helped improve learning;
- How the Teacher inspired interests and/or career aspirations;
- How the Teacher fosters an inclusive learning environment;
- How the Teacher helped the student(s) realize and act upon their strengths;
- How the Teacher makes use or could benefit from the use of technology in the classroom.
PRIZES : There are 15 prizes available to be won. Each selected Entrant will receive a certificate and an invitation to the Recognition Package Delivery celebration, subject to the School’s approval. There is a limit of one (1) Prize per Entrant.
AWARDS : Each Teacher who is the subject of a winning Entrant’s Entry will receive a Microsoft Teacher Recognition Package which will include Microsoft swag (“Recognition Package”) that will be presented to them in-person, where possible and subject to School approval, at a Recognition Package Delivery celebration with balloons and light refreshments at their current school of employment (the “School”). The School employing the Teacher of the first place entrant will receive 15 HP Probook x360 11 G1 device + 1 HP Probook x360 440 G1 device (“Technology Package”). The following four (4) Schools employing the Teachers of the 2nd-5th place entrants will receive one (1) HP Probook x360 440 G1 device. In the event that a Teacher is employed by more than one school, Microsoft will determine at its sole discretion to which of those schools the Technology Package will be awarded. There is a limit of one (1) Technology Package per School. In the event more than one (1) teacher is an employee of a School eligible for a Technology Package, it will be awarded to the School of the Teacher of the next eligible entrant and the process will continue until all Technology Packages are awarded.
Prizes and Awards are not transferable and must be accepted as awarded with no substitutions, whether in cash or otherwise, except at Sponsors’ sole discretion. Sponsors reserve the right to substitute a prize or award of equivalent value if a prize or award cannot be awarded as described for any reason. Prizes and Awards will only be delivered to the verified winning Entrants, Teachers and Schools as the case may be. Please allow eight (8) weeks for delivery. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate Entrant.
WINNER SELECTION : On or around September 25, 2018 at approximately 4:00pm ET at 1950 Meadowvale Boulevard, Mississauga, Ontario, 15 Entries will be selected based on the following equally weighted judging criteria:
- Creativity and ingenuity put into each Entry submitted;
- The impact the educator had on his or her student(s) as described in the submission.
RELEASES : By entering, you agree to release and hold harmless the Sponsors, the affiliates of the foregoing and all of their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Contest or, should you be a winner, the Prize. Teachers recognized through the winning Entries understand that they will be (a) accepting the Technology Package on behalf of the School to which they currently belong or, if a Teacher works at more than one School, on behalf of the School as designated by the Sponsor at their sole discretion; (b) required to sign a Declaration and Release form confirming that they (i) are accepting, and have authority to by virtue of a letter from the Ethics Manager to accept, the Technology Package on behalf of the School; (ii) release Microsoft from all liability in connection with the Technology Package; and, (iii) consents to the use of their name, city and/or province/territory of residence, photograph, voice, image, likeness and biographical information, for any publicity or programming purposes, commercial or otherwise, throughout the world in any and all media used by Microsoft and its advertising and promotional agencies in connection with the contest, without payment or compensation.
LIMITATIONS OF LIABILITY : Without limiting the release provided in Paragraph 6 above, and for greater certainty, Releasees will not be liable for: a) any incomplete or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; b) the theft, destruction or unauthorized access to, or alteration of, entries; c) any problems with, or technical malfunctions of, telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; d) any failure of any e-mail to be received by or from Sponsors for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof; or e) damage to a participant’s or other person’s system occasioned by participation or downloading of materials in this Contest.
OWNERSHIP : By entering this contest, entrants grant to Microsoft a perpetual, irrevocable, royalty-free license, throughout the universe, for Microsoft and its affiliates, to (a) use, reuse, distribute and otherwise exploit the Contest Entry or Entries in all media and languages; and (b) modify, translate, localize, edit and combine the Contest Entry or Entries with any other material in any form, languages and media as Microsoft selects in its sole discretion. Each entrant further agrees to waive all moral rights in each Entry in favour of Microsoft.

RIGHT TO TERMINATE, SUSPEND OR AMEND: Subject to obtaining the approval of the Régie des alcools, des courses et des jeux for the province of Quebec, Sponsors reserve the right to terminate, suspend or amend this Contest, in whole or in part, at any time without prior notice, if any factor interferes with its proper conduct as contemplated by these Official Rules.
MISCELLANEOUS: :Entrants who have not complied with these Official Rules are subject to disqualification from this Contest and any future contest or other promotion conducted by Sponsors. All decisions of Sponsors and the contest judging organization, as the case may be, are final and binding in all matters relating to this Contest. No correspondence will be entered into except with selected Entrants, Teachers and Schools. Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited.
In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A selected entrant may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. Anyone found to be using multiple accounts to enter will be disqualified.
Sponsors reserve the right at their sole discretion to disqualify, from this Contest and any future Contest or other promotion conducted by Sponsors, any individual that they find or believe to be tampering with the entry process or the operation of the Contest or Contest Website; to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
QUEBEC RESIDENTS : Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
PRECEDENCE : In the event of any discrepancy or inconsistency between these Official Rules and other statements contained in any contest-related materials, including but not limited to the contest entry form, point of sale, television, print or online advertising, these Official Rules shall prevail, govern and control.
